What happens if medical emergencies cause an accident?

Car accidents caused by sudden medical emergencies arise when a driver experiences a sudden, unforeseen medical event, such as a heart attack, seizure or loss of consciousness. As a result, it causes them to lose control of their vehicle. While tragic, these incidents differ from typical car accidents because they involve drivers who may not have acted negligently but were incapacitated by circumstances beyond their control. 

In Florida, the sudden medical emergency principle can absolve a driver from liability if they can prove the medical condition was unexpected and unavoidable. However, such cases are rarely straightforward, requiring extensive documentation and expert testimony to establish the validity of the emergency. 

Is a medical emergency a valid legal defense in a Florida car accident? 

The “sudden medical emergency” defense in Florida operates under the notion that a driver cannot be held liable for an accident if they have no control over their actions due to a sudden and unforeseeable health event.  

To successfully use this defense, the driver must prove specific elements such as: 

  • The medical emergency was truly unexpected 
  • They had no prior warning or symptoms 
  • The event directly caused the accident 

For example, if a driver suffered a seizure without a history of seizures or symptoms, the court may consider the defense valid. 

However, this defense does not apply in every case. If the driver had prior knowledge of a medical condition that could impair their ability to drive safely, such as a history of fainting spells or untreated conditions, they may be held liable.  

Additionally, courts examine if the driver took reasonable precautions, like avoiding driving if they felt unwell or had been warned by a doctor. Accidents caused by sudden medical emergencies are one of the most complex cases under Florida law.
